These Terms of Service (“Terms”) govern your access to and use of Fotovyn, an AI-powered photoshoot and visual-generation platform that enables users to create model photoshoots, virtual try-ons, professional headshots, and related commercial visual content (the “Service”).
By accessing, registering for, uploading content to, purchasing credits from, or using Fotovyn, you agree to be bound by these Terms, our Privacy Policy, any Refund Policy, any AI Usage Policy, any Community Guidelines, and any additional terms shown in the product or during checkout. If you do not agree, do not use Fotovyn.
1. Definitions
“Fotovyn,” “we,” “our,” or “us” means the operator of the Fotovyn platform. Insert the legal entity name before publication.
“User,” “you,” or “your” means any individual, business, brand, creator, agency, professional, or other entity that accesses or uses the Service.
“Service” means Fotovyn’s website, web application, studio tools, AI workflows, APIs if any, payment/credit system, dashboards, image upload flows, generated-output flows, and related support services.
“Input” means any image, photo, garment image, product image, portrait, selfie, prompt, text instruction, reference file, brand asset, logo, metadata, or other material you upload, submit, or provide to Fotovyn.
“Output” means any AI-generated, AI-edited, enhanced, processed, or returned image, preview, download, or other result created through the Service from your Input and/or selected workflow.
“User Content” means Input and Output together, including any files or materials associated with your account.
“Credits” means the platform units used to access generation features. Credits are a usage mechanism and are not cash, stored value, or currency.
“Beta Service” means any early-access, beta, experimental, preview, or test version of the Service or any feature.
2. Eligibility and Authority
You may use Fotovyn only if you can legally enter into a binding agreement. If you use Fotovyn on behalf of a business, brand, agency, employer, client, or other entity, you represent and warrant that you have authority to bind that entity to these Terms.
You must provide accurate and current account information.
You are responsible for maintaining the confidentiality of login credentials.
You are responsible for all activity under your account, including activity by employees, contractors, clients, or team members you allow to use your account.
You must notify Fotovyn promptly if you suspect unauthorized account access.
Unless permitted by Fotovyn in writing, you must not share accounts, resell access, or allow unrelated third parties to use your account.
3. Overview of Fotovyn Services
Fotovyn provides AI-assisted image workflows. The launch version may include:
Model Photoshoots: generating model-style, studio-style, editorial-style, or product/fashion visuals from uploaded product or fashion images.
Virtual Try-Ons: generating images that show a person wearing or appearing with a garment or fashion item based on a person image and garment image.
Professional Headshots: generating professional portrait or profile-style outputs from a portrait, selfie, or similar photo.
Job Progress, Results Gallery, Downloads, Credits, Billing/Upgrade Contact Flow, Account Settings, and internal admin functionality.
Fotovyn may add, remove, suspend, rename, limit, or modify workflows, presets, upload requirements, output sizes, generation limits, supported formats, credit costs, and other features at any time, especially during beta testing.
4. Beta Nature of the Service
Fotovyn may initially be offered as a beta or early-access product. Beta Services are provided for testing and evaluation. They may contain errors, interruptions, output failures, inaccuracies, quality issues, or availability limitations.
Beta features may change or be discontinued without prior notice.
Output quality may vary depending on input quality, lighting, pose, garment visibility, face visibility, prompt settings, and AI-provider performance.
Beta results should be reviewed carefully before commercial use.
Fotovyn does not guarantee that a beta feature will become a permanent feature.
During beta, Fotovyn may manually review jobs, adjust credits, provide manual support, and request feedback to improve the Service.
5. Account Registration and Security
To use certain features, you may need to create an account. You agree to provide truthful, accurate, complete, and updated information. Fotovyn may refuse, suspend, or terminate accounts that use false information, impersonate others, abuse trials, create duplicate accounts to obtain extra credits, or violate these Terms.
If forced password change, admin seed accounts, or internal access controls are enabled, those features are for security and operational purposes. Internal admin accounts must be used only by authorized Fotovyn personnel.
6. User Inputs: Rights, Permissions, and Responsibility
You are fully responsible for all Inputs you upload or submit. You represent and warrant that:
You own the Input or have all rights, licenses, permissions, consents, and releases required to upload and use it with Fotovyn.
Your Input does not infringe copyright, trademark, design rights, publicity rights, privacy rights, confidentiality obligations, contractual obligations, or other rights of any person or entity.
If your Input contains a person’s face, body, likeness, identifiable features, or personal data, you have obtained all legally required consent from that person.
If your Input contains a model, employee, influencer, customer, client, or third-party person, you have obtained the consent needed for AI processing and intended commercial use.
If your Input contains a garment, product, logo, brand asset, or protected design, you have the rights required to use it and generate derivative or promotional materials from it.
Your Input is not unlawful, harmful, misleading, sexually exploitative, abusive, defamatory, harassing, hateful, fraudulent, or otherwise prohibited under these Terms.
Fotovyn does not verify that you own or control all rights in your Input. You remain responsible for rights clearance and commercial approval before using any Output publicly or commercially.
7. License You Grant to Fotovyn
You retain any rights you have in your Input. To provide the Service, you grant Fotovyn a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, copy, upload, download, process, transmit, display, modify, transform, create intermediate files from, generate Outputs from, and otherwise use your Input and Output as necessary to:
operate, provide, maintain, secure, and improve the Service;
process AI generation jobs and return results;
provide support, troubleshoot errors, detect abuse, and prevent fraud;
enforce these Terms and comply with applicable law;
perform internal quality testing and reliability improvement, subject to the Privacy Policy and any product settings or written commitments applicable to your account.
Fotovyn will not use your private uploaded images in public marketing without your permission. If Fotovyn wants to use your before/after examples, testimonials, brand name, logo, or outputs for marketing, we should obtain your consent, unless the content was already made public by you in a way that permits such use.
8. AI Outputs: Ownership and Use
Subject to your compliance with these Terms, payment of applicable fees, and any restrictions displayed in the Service, Fotovyn grants you the right to download and use Outputs generated through your account for lawful personal or commercial purposes.
However, AI-generated outputs can raise legal and practical uncertainty. You acknowledge and agree that:
Fotovyn does not guarantee that any Output is unique, copyrightable, trademark-safe, design-right-safe, publicity-right-safe, or free from third-party claims.
Similar or identical outputs may be generated for other users, especially where similar inputs, prompts, styles, or presets are used.
You are responsible for reviewing Outputs before publishing, advertising, selling, printing, uploading to marketplaces, or using them commercially.
You must not use Outputs to mislead people into believing that a real photoshoot, endorsement, model appearance, partnership, certification, or event occurred when it did not.
You must comply with advertising, consumer-protection, platform, marketplace, and industry-specific rules when using Outputs.
If a workflow, plan, or beta feature is marked as “personal use only,” “internal testing,” “non-commercial,” or similar, you must not use those Outputs commercially unless Fotovyn gives written permission.
9. No Guarantee of Legal Clearance or Professional Advice
Fotovyn is a technology platform. It does not provide legal, advertising, intellectual-property, privacy, consumer-protection, tax, accounting, or professional advice. Output availability does not mean the Output is legally cleared for your intended use.
For commercial campaigns, packaging, paid advertisements, celebrity/likeness use, marketplace listings, influencer content, or high-risk brand use, you should obtain appropriate legal review.
For fashion products, you should confirm that generated images accurately represent the garment, color, fabric, size, fit, and appearance before using them in product listings or advertisements.
For headshots and portraits, you should confirm that the person has approved the final Output before public or professional use.
10. Virtual Try-On and Fashion Accuracy Disclaimer
Virtual try-on and model photoshoot Outputs are AI-generated approximations. They may not perfectly reflect actual size, fit, fabric behavior, stitching, drape, color, logo placement, garment construction, body shape, or product appearance.
You must not use Outputs in a way that materially misrepresents products to consumers. If you use Outputs for e-commerce or advertising, you are responsible for ensuring that product descriptions, disclaimers, sizing information, and visual representations comply with applicable consumer-protection and advertising laws.
11. Headshot and Likeness Disclaimer
Professional headshot Outputs may alter appearance, skin texture, lighting, clothing, background, expression, age perception, facial features, hair, or other attributes. You must obtain consent from the person depicted before uploading their image and before using resulting Outputs publicly or commercially.
You must not create or use headshots to impersonate another person, misrepresent identity, create fake employees, fake professionals, fake endorsements, fake profiles, fraudulent documents, deceptive recruitment materials, or misleading public statements.
12. Prohibited Uses
You must not use Fotovyn, Inputs, or Outputs to create, upload, generate, promote, distribute, or facilitate:
Child sexual abuse material, sexualized images of minors, grooming content, exploitation of minors, or any content involving minors in sexual, suggestive, abusive, or unsafe contexts.
Non-consensual intimate imagery, sexual deepfakes, nude or sexual images of real persons without consent, or content intended to harass, shame, blackmail, or exploit a person.
Impersonation, identity fraud, fake documents, fake official credentials, fake endorsements, fake reviews, fake testimonials, or deceptive representations of a real person or brand.
Content that infringes or imitates protected characters, celebrities, artists, brands, logos, trade dress, copyrighted works, or distinctive styles where you do not have rights or permission.
Hateful, discriminatory, abusive, threatening, harassing, defamatory, violent, extremist, terrorist, or unlawful content.
Political persuasion, voter manipulation, deceptive public-interest content, misinformation, or content that falsely appears to be from a public official, candidate, news organization, or institution.
Medical, legal, financial, or other professional representations that are false or misleading.
Fraud, scams, phishing, credential theft, malware, scraping, spam, mass unsolicited messaging, or abuse of payment systems.
Attempts to bypass safety filters, rate limits, credit limits, authentication, access controls, or technical protections.
Reverse engineering, model extraction, prompt injection, security testing without permission, or attempts to discover underlying provider credentials, prompts, systems, or infrastructure.
Any content or activity that violates applicable law, third-party platform policies, payment-provider rules, or these Terms.
Fotovyn may reject, block, remove, or moderate Inputs or Outputs, suspend accounts, remove credits, withhold downloads, or report illegal content where required or appropriate.
13. Publicity, Marketing, and Consent for Before/After Examples
Fotovyn should obtain permission before publicly posting a user’s uploaded images, generated images, brand name, logo, testimonial, or before/after results. If you voluntarily submit content for a showcase, testimonial, beta case study, social post, or public launch material, you grant Fotovyn permission to use that content for marketing, portfolio, investor, and promotional purposes, unless otherwise agreed in writing.
You are responsible for ensuring that any person, model, customer, employee, influencer, creator, or photographer involved has also consented to such marketing use.
14. Content Moderation, Review, and Takedowns
Fotovyn may, but is not obligated to, review Inputs, prompts, Outputs, account activity, or support messages to operate the Service, improve quality, detect misuse, investigate complaints, comply with legal requests, and enforce these Terms.
If you believe content generated or hosted through Fotovyn infringes your rights, violates your privacy, uses your likeness without consent, or otherwise breaches these Terms, contact Fotovyn at [insert support/legal email] with:
Your name and contact information;
Identification of the disputed content;
A description of the rights or interests you claim are violated;
Any supporting proof of ownership, authority, or identity;
A statement that the information you provide is accurate.
Fotovyn may remove or restrict disputed content while reviewing the complaint. Fotovyn may also request additional information before taking action.
15. Intellectual Property Rights in Fotovyn
Fotovyn and its licensors own all rights in the Service, including software, interface design, source code, workflows, business processes, logos, trademarks, trade names, documentation, prompts, presets, templates, models, data pipelines, system configurations, and related technology, except for User Content and third-party materials.
You may not copy, modify, distribute, sell, lease, reverse engineer, scrape, frame, mirror, or build a competing service using Fotovyn’s software, outputs as a training corpus, workflows, interface, internal logic, or proprietary materials except as permitted in writing.
16. Third-Party Services and AI Providers
Fotovyn may rely on third-party providers for AI generation, storage, hosting, analytics, payments, email delivery, authentication, monitoring, and other infrastructure. Your use of Fotovyn may be subject to additional third-party terms, policies, restrictions, and availability limitations.
AI-provider outages, rate limits, policy changes, model changes, or quality changes may affect Fotovyn outputs.
Payment-provider delays, declines, settlement requirements, fraud reviews, or account restrictions may affect purchases and upgrades.
Fotovyn is not responsible for third-party services outside Fotovyn’s reasonable control.
17. Credits, Pricing, and Billing
Fotovyn may use a credit-based system. Credit costs may vary by workflow, image count, output quality, provider cost, resolution, retry requirements, or feature type. Fotovyn may change pricing, credit costs, package sizes, free trials, promotional credits, and credit rules at any time, but changes should not retroactively remove paid credits except where required for fraud, chargeback, misuse, or violation of these Terms.
Credits are not legal tender, currency, stored value, deposit accounts, or financial instruments.
Credits may be used only within Fotovyn and may not be transferred, resold, exchanged, or redeemed for cash unless required by law or agreed in writing.
Trial, promotional, complimentary, or manually granted credits may expire, be limited, or be revoked if abused.
Generation attempts may consume credits once processing begins, unless Fotovyn’s product rules state otherwise.
Failed jobs caused by platform/provider errors should not incorrectly charge users. Fotovyn may restore credits for confirmed technical failures at its discretion or according to the Refund Policy.
Jobs that fail because of prohibited content, low-quality inputs, unsupported file types, user cancellation, or user error may not be eligible for credit restoration unless Fotovyn decides otherwise.
Before payment, users should be shown material purchase information such as price, credit quantity, payment method, contact/support path, and applicable refund rules.
18. Payments, Manual Payment Fallback, and Taxes
Payments may be processed through third-party payment providers or manual payment methods such as bank transfer during beta. You agree to provide accurate billing information and authorize Fotovyn or its payment provider to charge applicable amounts.
Fotovyn does not directly store full card numbers unless explicitly stated; payment information is normally processed by third-party payment processors.
Manual bank-transfer upgrades may require proof of payment and manual credit allocation.
Credits may be added only after payment is verified.
You are responsible for taxes, duties, bank charges, currency conversion charges, and payment-provider fees unless stated otherwise.
Fotovyn may refuse, reverse, suspend, or review transactions suspected of fraud, abuse, chargeback risk, or violation of payment-provider rules.
19. Refunds and Failed Generations
Refunds, credit restoration, and failed-generation handling should be governed by Fotovyn’s separate Refund Policy. Until a separate policy is published, the following beta approach may apply:
If a job fails due to Fotovyn system error, provider outage, storage error, or processing failure, Fotovyn may restore credits or retry the job.
If a job produces low-quality or undesirable output but technically completes, Fotovyn may review the case but does not guarantee a refund unless required by law or stated in a published offer.
If the user uploads blurry, low-resolution, incomplete, misleading, unsupported, or rights-infringing Inputs, Fotovyn may refuse refunds or credit restoration.
If a user violates these Terms, Fotovyn may suspend access without refund, subject to applicable law.
Paid purchases should clearly link to the Refund Policy before checkout once available.
20. Acceptable Input Quality and User Guidance
To improve results, users should follow upload guidance shown in the Service, such as using clear, high-resolution images, good lighting, unobstructed garments, visible faces where relevant, single subjects where requested, and accurate workflow selection. Fotovyn is not responsible for poor results caused by poor input quality or incorrect workflow use.
21. Privacy and Data Protection
Fotovyn’s collection, use, storage, disclosure, retention, and protection of personal data is described in the Fotovyn Privacy Policy. By using the Service, you acknowledge that uploaded content may include personal data, biometric-like facial information, likenesses, or other sensitive material, and you confirm that you have all required rights and consents for such processing.
If you use Fotovyn on behalf of a business and upload images of employees, models, customers, influencers, or other individuals, you are responsible for providing any required notices and obtaining any required consent under applicable data-protection and privacy laws.
22. Confidentiality and Business Users
If you upload confidential business materials, unreleased products, private campaign materials, or client assets, you are responsible for ensuring that use of Fotovyn is permitted by your confidentiality obligations. Fotovyn will take reasonable measures described in the Privacy Policy and internal security practices, but the Service should not be used for highly confidential, regulated, or sensitive materials unless Fotovyn has provided appropriate written assurances.
23. User Feedback
If you provide ideas, suggestions, bug reports, quality feedback, feature requests, workflow suggestions, marketing ideas, prompt suggestions, or other feedback, you grant Fotovyn a perpetual, worldwide, irrevocable, royalty-free license to use that feedback without restriction or compensation. Fotovyn may use feedback to improve, modify, market, or commercialize the Service.
24. Service Availability, Changes, and Suspension
Fotovyn may modify, suspend, limit, or discontinue any part of the Service at any time. We do not guarantee uninterrupted availability, error-free operation, fixed generation times, permanent storage, or continued access to any particular feature, workflow, model, provider, output style, or pricing plan.
Users should download important Outputs promptly. Fotovyn may apply storage limits, retention periods, account deletion rules, or gallery-cleanup policies as described in the product or Privacy Policy.
25. Termination
You may stop using Fotovyn at any time. Fotovyn may suspend or terminate your account, remove content, limit features, revoke credits, or block access if:
You violate these Terms or any related policy;
Your account creates legal, security, reputational, payment, abuse, or operational risk;
You infringe third-party rights or upload unauthorized content;
You abuse trials, credits, payment systems, support, or infrastructure;
We are required or advised to do so by law, payment providers, hosting providers, AI providers, or regulators.
Upon termination, your right to use the Service ends immediately. Sections intended to survive termination, including ownership, user responsibility, disclaimers, indemnity, liability limits, dispute resolution, and payment obligations, will survive.
26. Disclaimers
To the maximum extent permitted by law, Fotovyn is provided “as is” and “as available.” Fotovyn disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, quality, and uninterrupted operation.
We do not guarantee any specific output quality, realism, legal clearance, uniqueness, commercial performance, conversion rate, sales result, or social media performance.
We do not guarantee that Outputs will be accepted by any marketplace, platform, advertiser, government authority, employer, client, or third-party reviewer.
We do not guarantee that Outputs will be free from visual defects, artifacts, distortions, inaccurate garment rendering, face changes, background issues, or other AI limitations.
You use Inputs and Outputs at your own risk.
27. Limitation of Liability
To the maximum extent permitted by law, Fotovyn and its owners, directors, officers, employees, contractors, affiliates, agents, suppliers, AI providers, payment providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, goodwill, revenue, business opportunities, reputation, or expected savings, even if advised of the possibility of such damages.
To the maximum extent permitted by law, Fotovyn’s total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of:
the amount you paid to Fotovyn for the specific transaction or credits giving rise to the claim during the three months before the claim arose;
Some jurisdictions do not allow certain limitations of liability. In such cases, liability will be limited to the maximum extent permitted by applicable law.
28. Indemnity
You agree to defend, indemnify, and hold harmless Fotovyn and its owners, directors, officers, employees, contractors, affiliates, agents, suppliers, AI providers, payment providers, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of or relating to:
your use of Fotovyn, Inputs, or Outputs;
your breach of these Terms or any related policy;
your violation of law or third-party rights;
your lack of required consent, release, license, or authorization;
your use of Outputs in advertising, commerce, product listings, social media, employment, identity, or client work;
any dispute between you and your clients, customers, models, photographers, employees, influencers, agencies, or business partners.
29. Consumer Protection and E-Commerce Transparency
Fotovyn should provide users with clear information before purchase, including material features, pricing or credit cost, payment process, refund rules, support contact, and redress options. Users should carefully review these details before purchasing credits or using Outputs commercially.
If Fotovyn sells to consumers, local consumer-protection rules may impose obligations that cannot be excluded by these Terms. Nothing in these Terms is intended to limit non-excludable consumer rights.
30. Electronic Communications and Contracting
You agree that agreements, notices, disclosures, account messages, payment confirmations, policy updates, and other communications may be provided electronically. Your use of the Service, account registration, checkout confirmation, click acceptance, continued use after policy updates, or other electronic actions may form legally binding consent where permitted by law.
31. Governing Law and Dispute Resolution
These Terms are governed by the laws of Sri Lanka, unless Fotovyn’s legal counsel selects another governing law before publication. The parties should first attempt to resolve disputes informally by contacting [insert support/legal email].
If a dispute cannot be resolved informally within [30] days, the dispute may be submitted to the courts of Sri Lanka or another dispute-resolution process selected by legal counsel. Before publishing, Fotovyn should obtain legal advice on whether to include court jurisdiction, arbitration, mediation, small-claims rules, class-action waiver, or consumer-specific provisions.
32. International Users
Fotovyn may be accessed from outside Sri Lanka. You are responsible for complying with laws applicable to your location and intended use, including privacy, publicity rights, advertising rules, consumer-protection laws, intellectual-property laws, export controls, sanctions, and platform policies.
33. Changes to These Terms
Fotovyn may update these Terms from time to time. We may notify users by posting the updated Terms, updating the “Last Updated” date, sending an email, displaying an in-product notice, or using another reasonable method. Continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree, you must stop using the Service.

35. Plain-English Launch Summary for Users

Only upload images you have the right to use.
Get consent before uploading someone’s face, body, portrait, or likeness.
